These Terms of Service ("Terms") govern your use of the Artcolex gallery management platform ("Service"). By registering for or using the Service, you agree to these Terms.
Artcolex is a cloud-based SaaS platform that provides artwork management, sales tracking, collection sharing, and reporting capabilities for art galleries and collectors. The Service is provided "as is." Artcolex does not guarantee that the Service will be uninterrupted, error-free, or completely secure. Planned maintenance windows will be communicated in advance.
• You must create an account with a valid email address to use the Service. • You must be at least 18 years old to use the Service. • All information provided during registration (name, institution, email, etc.) must belong to a real person or entity. Providing false or misleading information may result in immediate account termination. • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. • You may not share your account with others. • If you suspect a security breach, notify us immediately at info@artcolex.com.
• Artcolex is offered on a monthly subscription basis. Plans and pricing are listed at artcolex.com/pricing. • Payments are processed by Paddle (paddle.com), who acts as the Merchant of Record. Your payment information is not stored by Artcolex. • Subscriptions automatically renew at the end of each billing period. To cancel auto-renewal, you must complete the cancellation at least 24 hours before the next billing date. • Price changes will be notified at least 30 days in advance by email. Continued use of the Service after notification constitutes acceptance of the new pricing.
• You may cancel your subscription at any time from Settings → Subscription. • Cancellation takes effect at the end of the current billing period; no refunds are provided for unused time. • If you are not satisfied within the first 21 days, you may request a full refund by emailing info@artcolex.com (21-day money-back guarantee). • Proportional credits may be considered for service outages caused by technical failures; contact info@artcolex.com to report. • Refunds are processed through Paddle and will appear in your account within 5-10 business days.
You may not use the Service for: • Hosting illegal content or conducting illegal activities. • Infringing copyright or intellectual property rights. • Spreading spam, malware, or harmful content. • Overloading the Service infrastructure or compromising its security. • Attempting to gain unauthorized access to other users' accounts. • Reselling or sublicensing the Service (without prior written consent). • Uploading obscene, pornographic, violent, or socially harmful content — even if presented as art. • Sharing materials containing hate speech, discrimination, or harassment based on race, religion, gender, ethnicity, or other characteristics. • Uploading or sharing another person's personal information (name, photo, contact details, etc.) without their explicit consent. • Hosting content that exploits or is harmful or inappropriate towards individuals under 18. • Sending advertisements, marketing messages, pyramid schemes, or bulk commercial messages through the platform. • Uploading or offering for sale works whose copyright belongs to another party, without permission from the rights holder. • Uploading or selling replicas, copies, or counterfeit works reproduced without the artist's consent. Violation of these rules may result in account suspension or immediate termination without providing any reason.
• All artworks, sales records, customer information, and other content you upload to the platform ("Customer Data") belong to you. Artcolex claims no ownership over your data. • Artcolex processes Customer Data solely for the purpose of delivering the Service; it is not used for marketing, sales, or sharing with third parties. • Artcolex may analyze anonymous and aggregated usage statistics for service improvement purposes.
• The Artcolex platform (including code, design, brand, and logo) belongs to Artcolex and is protected by copyright, trademark law, and other intellectual property laws. • These Terms grant you a limited, non-transferable, non-exclusive license to use the Service. • You may not use the "Artcolex" name, logo, or brand without prior written permission.
To the maximum extent permitted by law: • Artcolex shall not be liable for data loss, business interruption, loss of revenue, or indirect damages. • Artcolex's total liability shall not exceed the greater of the subscription fees paid by you in the three (3) months preceding the event giving rise to liability, or USD 100. • Artcolex shall not be liable for issues arising from outages at third-party infrastructure providers. This limitation does not apply to damages arising from Artcolex's gross negligence or intentional misconduct. You acknowledge that content you upload to the platform (artwork images, customer information, pricing, etc.) may be sensitive or private in nature. The gallery owner or user who uploads such content is solely responsible for any damages or losses arising from the uploading of such content and any unauthorized access to it; Artcolex shall not be liable for damages arising from user-uploaded content. If you are dissatisfied with the Service, its content, or any provision of these Terms, your sole and exclusive remedy is to discontinue use of the Service.
Termination by Artcolex: • In case of a Terms violation, or without providing any reason, your account may be suspended or terminated without prior notice. • If the Service is shut down entirely, at least 90 days' notice will be given by email and a reasonable period to export your data will be provided. Termination by User: • You may cancel your subscription at any time. • After termination, your data will be retained for 1 year (as stated in the Privacy Policy), then permanently deleted.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Artcolex does not warrant that the Service will be uninterrupted, error-free, or secure; that it will meet your requirements; or that the results obtained from using the Service will be accurate or reliable. Artcolex expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the Service is at your sole risk.
You agree to indemnify and hold harmless Artcolex from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
Artcolex reserves the right to modify, update, or discontinue the Service or any features or pricing with prior notice. Feature removals or significant changes will be communicated at least 30 days in advance. Minor updates and improvements may be applied without notice.
The Service may contain links to third-party websites or services. These links are provided for convenience only. Artcolex accepts no responsibility for the content, privacy policies, or practices of any third-party sites. Your use of third-party sites is entirely at your own risk.
The Service is provided through Paddle acting as the Merchant of Record. Paddle acts as the legal seller to end customers and calculates, collects, and remits applicable VAT, GST, and other consumption taxes to the relevant tax authorities. For business (B2B) customers, compliance with tax regulations in your jurisdiction (including VAT/GST reverse charge mechanisms) is your responsibility. You are required to provide a valid tax identification number upon request. Artcolex shall not be held liable for any penalties, fines, or liabilities arising from your failure to meet your personal tax obligations.
You may not use the Service for: • Collecting content, data, or information for the purpose of training any machine learning or artificial intelligence (AI) system. • Using automated tools, bots, spiders, or scrapers to bulk-collect content from the Service. • Attempting to disable or circumvent any technical protection measures of the Service. • Placing a disproportionate load on our network or infrastructure. Violation of these rules may result in immediate account termination and legal action.
If you believe content on our platform infringes your copyright, please send a notice including: • Signature of the rights holder or authorized representative. • Description of the copyrighted work claimed to be infringed. • Location of the allegedly infringing content on the platform. • Your contact information (name, email, address). • A good-faith statement that the content is used without authorization. • A statement of accuracy of the information provided. Send notices to: info@artcolex.com — Subject: "Copyright Infringement" We will review valid notices within 5 business days and take appropriate action.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
These Terms do not create any partnership, joint venture, employment, or agency relationship between Artcolex and the user. Both parties act independently; neither party has the authority to represent, bind, or assume obligations on behalf of the other.
We may update these Terms from time to time. Significant changes will be notified by email and by updating the "Last updated" date on this page. Continued use of the Service after notification constitutes acceptance of the new Terms.
These Terms are governed by the laws of the Republic of Turkey. In the event of a dispute, the parties will first attempt to resolve it amicably. If resolution cannot be reached, the courts and enforcement offices of Ankara shall have jurisdiction.
Artcolex is a software platform (SaaS) developed for art galleries, artists, and collectors. Artworks listed on the platform are managed by gallery owners and artists; Artcolex is not the seller, intermediary, or representative of these works. As a visitor or potential buyer, you acknowledge and agree that: • Artcolex provides no sales guarantee, authenticity guarantee, certificate of originality, or value commitment for any artwork listed on the platform. • All information regarding the accuracy, authenticity, price, or condition of listed artworks is provided by the relevant gallery or artist. Artcolex does not verify or warrant the accuracy of this information. • Artcolex shall not be held liable for any purchase, delivery, quality, authenticity, or any dispute arising between parties in connection with an artwork. • Information shared through the "Inquiry" form must be accurate and truthful. Misleading or spam submissions are prohibited. • Content accessible through share links is managed by the gallery owner. When the gallery owner revokes access, your access to the content will end; Artcolex accepts no responsibility in this regard. • Copying, reproducing, or using content viewed on the platform (images, text, pricing, etc.) for commercial purposes without written permission is prohibited. All legal responsibility related to the purchase and sale of artworks lies between the gallery owner and the buyer. Artcolex is not a party to these transactions.
